( – Judge Juan Merchan, who presided over the trial of former President Donald Trump’s business records, cautioned Trump’s lawyer, Todd Blanche, and Manhattan Assistant District Attorney Joshua Steinglass about a comment from someone claiming to be the cousin of one of the jurors.

Merchan wrote to Blanche and Steinglass to inform them that the court was “aware of a comment” made on the Unified Court System’s Facebook page, wherein a user disclosed the jury’s guilty finding one day before Trump’s conviction.

“Today, the Court became aware of a comment that was posted on the Unified Court System’s public Facebook page and which I now bring to your attention,” Merchan wrote in his letter.

“The comment, now labeled as one week old, responded to a routine UCS notice, posted on May 29, 2024, regarding oral arguments in the Fourth Department of the Appellate Division unrelated to this proceeding,” Merchan continued.

On May 30, Trump was found guilty on 34 counts of first-degree falsifying business documents about payments made to Stormy Daniels, a celebrity in the adult entertainment industry, during the 2016 presidential race.

Although Merchan mentioned in his letter that the comment could be viewed on the New York State Unified Court System’s Facebook page, the post appears to have been removed.

According to NBC News, a defendant seeking to overturn a decision on juror misconduct must demonstrate, through a preponderance of the evidence, that there was misconduct and that it “created a substantial risk of prejudice.”
