A divided Supreme Court on Tuesday overturned a Texas statute that gives police the authority to detain people they believe are crossing the border illegally. At the same time, a legal dispute over immigration jurisdiction is being resolved.
The Biden administration is suing to overturn the statute because it is an egregious breach of federal power, harms international relations, and throws immigration law administration into disarray. Then, a judge can mandate that they depart the country.
